These Terms of Use (the “Terms of Use”) govern access to and use of the “koibox.cloud” website (the “Website”) that Software Koibox, S.L. (hereinafter “Koibox”) makes available to you as a user of the Website (the «User» or “Users”
In addition, these Terms of Use establish together with the Privacy Policy and the Cookie Policy, regarding the management of personal data of Users, the Terms and Conditions governing the Website.
The use of the Website implies the full acceptance by the User of the Terms of Use in force at each time the User accesses the same. Therefore, if you do not agree with any of the conditions set forth herein, you must refrain from using this Website.
Koibox reserves the right to modify, without notice, at any time these Terms of Use, as well as its configuration, location and any other general or particular terms, rules of use, instructions or notices that result from application. Koibox also reserves the right to suspend, interrupt or stop operating the Website at any time.
1. GENERAL INFORMATION
n compliance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, informs users that the Website is owned by Koibox Software, S.L., company with registered office at Avenida Pío XII, 1 Valencia C.P. 46009, Spain, provided with C.I.F. nº B-98661028. Koibox is registered in the Commercial Register of Valencia, Volume 9814, Folio 37, Sheet Number V-161095.
Users may establish a direct and effective communication with Koibox by means of a written communication sent to the address indicated, as well as to the email address info@koibox.cloud.
This e-mail address will not accept the receipt of excessive personal data, not updated and incompatible with the activity carried out by Koibox. We inform you that if the request for which you wish to establish a contact relationship with Koibox does not meet these requirements will proceed to its destruction automatically.
2. OBJECT
Through the Website, Koibox provides Users with general information about the products and services that Koibox provides to its customers related to online management software specialized in the sector of beauty centers.
Koibox reserves the right to exercise all legal remedies available to enforce liability for any breach of these Terms of Use by Users.
3. CONDITIONS FOR ACCESSING AND USING THE WEBSITE
3.1. Access and use of the Website
Koibox requires its Users to use the Website and the content displayed on it responsibly and lawfully.
The User acknowledges that he is over eighteen (18) years old and accepts that access to and use of the Website and/or the content contained therein takes place freely and consciously, under his sole responsibility.
Access to the Website does not imply any guarantee with respect to the Website and/or the contents included, as it is for information purposes only. Thus, no guarantee is given as to their suitability for the particular or specific purposes that Users may expect or assume. The information provided may vary according to the modifications identified by Koibox.
Koibox may establish limitations and/or additional conditions for the use and/or access to the Website, which must be observed by the Users in any case.
3.2. Obligations of the User for the use of the Website
The User is obliged to comply with these Terms of Use, as well as to comply with the special warnings or instructions contained in the Website and to always act in accordance with the law, good customs and public order requirements and good faith, employing their utmost care and diligence. To this end, you will refrain from using the Website in any way that may prevent, hinder, damage or impair the normal functioning of the Website, the goods or rights of Koibox, its suppliers, the rest of the Users or any third party.
Specifically, by way of mere expression and without any restriction to the obligation assumed by the User in general in accordance with the preceding paragraph, the User undertakes to:
- Not to introduce or disseminate on or from the Website, any information or material that is defamatory, insulting, obscene, threatening, xenophobic, pornographic, apologetic to terrorism, incites violence to discrimination on grounds of race, sex, ideology, religion or that in any way violates the form, public order, fundamental rights, public freedoms, honour, privacy or the image of third parties and in general the regulations in force.
- Not to introduce, store or disseminate through the Website any computer program, data, virus, code, or any other instrument or device that is liable to cause damage to the Website, any of the services, or any of the equipment, systems or networks of Koibox, of any User or in general of any third party, capable of causing any kind of alteration or prevent the normal functioning of the same.
- Not to obstruct access to the Website to third parties.
- Not to engage in spamming, advertising, promotional or commercial exploitation of the Website. In such a way that the contents and in particular the information obtained through the Website will not be used to send advertising, send messages for direct sale or for any other commercial purpose, or to collect or store personal data.
- Not to destroy, alter, disable or damage Koibox’s electronic data, information, programs or documents displayed or included on the Website.
- Not to introduce or disseminate through the Website any content that violates the rules of intellectual property, industrial or third party rights, or in general any content of which does not have, in accordance with the law, the right to make it available to third parties.
3.3. Introduction and use of links
The link, such as hypertext, banners, buttons, directories and any other search tool, understood as technology connecting two websites or two web pages (hereinafter «Link») may not be used by Users to establish a connection to the Website. Access to the Website must be made through the URL and with the credentials assigned by Koibox without allowing unauthorized third parties access to the Website.
3.4. Use of Third Party Links on the Website
The installation of Third Party Links on the Website by Koibox is solely for the purpose of facilitating Users’ access to available information offered by third parties and does not imply that Koibox promotes, endorses, warrants or recommends third party websites. The links or links included in the Website are only offered as informative references, without any evaluation or guarantee about their contents, ownership, services or products offered from them. Furthermore, Koibox assumes no responsibility for its suitability, correctness and operation.
The Users must exercise maximum caution in the assessment and use of these Links, excluding any liability of Koibox in relation to information, data, files, products, services and any kind of material or intangible assets existing on the pages accessed through them.
4. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS
All content displayed on the Website, including without limitation, designs, photographs, texts, graphics, logos, or any other intangible assets protected by industrial and intellectual property regulations are subject to the intellectual and industrial property rights of Koibox or third party holders who have duly authorized Koibox for inclusion in the Website.
Under no circumstances shall any licence be granted or any waiver, transfer, transfer or partial transfer of such rights be granted, nor shall any right of exploitation be conferred on such assets.

5.1. Exclusion of warranties and liability for the operation of the Website
Koibox does not guarantee the availability and continuity of the operation of the Website and of the services or content offered on it, including with regard to its updating, being exempt from any liability for damages of any nature that may arise from such circumstances.
Koibox will carry out, as long as there are no circumstances that make it impossible or difficult to execute and as soon as it has news of the errors, disconnections and/or lack of updating of the contents, all those tasks aimed at correcting the errors, restore communication and/or update the referred contents.
Likewise, Koibox does not guarantee either the technical reliability of the Website or access to its various pages, being likewise exempt from any liability for damages of any kind that may arise from this cause.
In addition, Koibox is not responsible for any errors or security deficiencies that may occur due to the use by the User of an outdated or unsafe browser with respect to damages, errors or inaccuracies that could result from the malfunction of the same.
In order to reduce the risk of virus introduction on the Website, Koibox uses virus detection programs to control the contents that it introduces on the Website. However, Koibox does not guarantee the absence of viruses or other elements on the Website introduced by third parties outside Koibox that may cause alterations in the Users’ systems or in the electronic documents and files stored in their systems. Consequently, Koibox will not be liable in any case for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations in the systems, documents or files of the Users.
5.2. Exclusion of warranties and liability in connection with the use of third party Links on the Website
Koibox checks the existing content on the websites it links to at the time it establishes a link to them. Koibox includes such link on the Website at that time in the good faith belief that such content complies with applicable law. However, in no case does Koibox take responsibility, approve, or make own the products, services, contents, information, data, files and any kind of material existing on the websites of third parties and does not control or be responsible, approves or makes its own the successive modifications of these materials. In the event that it deems it appropriate or is requested by judicial or administrative order, Koibox will remove links to those websites that violate the applicable law and/or infringe the rights of third parties.
6. PARTIAL INVALIDITY
The declaration of any clause contained in these Terms of Use as void, invalid or ineffective shall not affect the validity or effectiveness of the remaining clauses, which shall remain binding between the parties. The waiver by either party to demand at a given time the fulfillment of any of the conditions stipulated herein shall not imply a general waiver of the fulfillment of another condition or conditions, or create an acquired right for the other party.
7. APPLICABLE LAW AND JURISDICTION
These Terms of Use shall be governed by the provisions of Spanish law. Any dispute arising from this will be submitted to the jurisdiction of the Courts and Tribunals of Valencia.
